Driver Partner Referral Promotion

Promotion Terms

1. The promoter of this promotion (“Promotion“) is ViaVan Transit B.V. (“Via”). Our registered company number is 69169969, and our registered office is at Vijzelstraat 68, 1017 HL, Amsterdam. The Promotion is organised to promote the use of the ViaVan app by drivers in the Netherlands. Via acts in accordance with the Dutch Code of Conduct for promotional games of chance.
2. The Promotion is only open to Driver Partners who are in good standing, have “active status”, are validly registered to drive with ViaVan on the ViaVan platform (the “Platform”) in Amsterdam, are aged 18 or more and residing in the Netherlands. Officers, employees and agents of ViaVan, anyone professionally associated with this Promotion, and members of the respective families of any of the foregoing are not eligible to participate in the Promotion. No purchase required.
3. By entering the Promotion, you will be deemed to accept these terms, together with all entry instructions, which form part of these terms. These terms can be read on the ViaVan Platform.  
4. The prize (up to two televisions) with a max value of 1.500 € (“Prize”)  will be given away during the Promotion.
5. The opening date for entry is Wednesday, June 6, 2018. To enter, refer at least 1 driver partner before the closing date for entry, which is 11.59pm on Tuesday, June 26, 2018. Only referred driver partner that have at least completed one ride before this time will be counted for the promotion.   
6. We reserve the right, in our sole discretion, to disqualify any entrant who cheats or who tampers or attempts to tamper with the entry process for, or the operation of, the Promotion, or whose conduct is in breach of these terms, contrary to the spirit of these terms or the intention of the Promotion, or might, in our reasonable opinion, bring us, any of our affiliates or any of our or their respective brands into disrepute.
7. There will be one or two Prize winners (“Winner(s)”) that will be drawn at random on June 27, 2018. The probability of selection  increases with the number of referred driver partner The draw will be made, or observed, by an independent person. The Winner will be drawn and notified in person, by email and/or SMS within two days of selection.
8. Each Winner’s entitlement to the Prize is non-transferable.
9. The Prize is provided on an ‘as is’ basis’ and is non-negotiable.
10. The Prize will be handed-out to each Winner within 7 days of the closing date.
11. Each Winner is solely responsible for the payment of any applicable tax in relation to the Prize and for any costs associated with the Prize or its use, including without limitation the cost of complying with any requirements of applicable law.
12. Where the Prize consists of an event, activity, holiday or the performance of a service, each Winner is solely responsible for complying with any booking or other conditions or instructions of the relevant third party provider or organiser and must be able to comply with any restrictions as to dates and times in relation to the Prize (which may not be re-scheduled) and any other eligibility restrictions imposed by the relevant third party provider or organiser. The contract in relation to any such event, activity, holiday or service will be directly between the Winner and the relevant third party provider or organiser and we will not be a party to that contract or have any liability in relation to its performance or non-performance, which shall be the sole responsibility of the relevant third party provider or organiser. We will not provide any form of insurance, including without limitation any public liability or cancellation insurance, in respect of any Prize consisting of an event, activity, holiday or service.
13. Our offering of a particular Prize implies no affiliation on our part with or sponsorship or endorsement of the relevant third party manufacturer, supplier, provider or organiser.
14. Each Winner is solely responsible for all use made of the Prize by him or her. Except as expressly provided in these terms, no representations, warranties, conditions or other terms are made, given or accepted by us and no other terms shall apply, as between us and any person, in relation to the Prize, including without limitation any terms as to suitably, reliability, satisfactory quality or fitness for purpose, or any other implied terms, all of which we exclude to the maximum extent permitted by law.
15. Each Winner may be required to take part in some promotional activity, such as publicity photographs, as a condition of receiving the Prize.
16. Each Winner’s name and business may be posted on our website(s), and social media channels and referenced in our promotional emails and literature.
17. By participating in the Promotion, you agree that, if you win, you will co-operate in all advertising, marketing and publicity material and activities we may, at our expense, produce or arrange and you will sign, if requested, an irrevocable release form allowing us, without any compensation being payable, to use your name, photograph, likeness, details of the country and/or city where you live, any comments made by or attributed to you, and to incorporate any such information in and any audio/visual recording or broadcast for such promotional purposes, in any media, throughout the world.
18. You agree that our decision is final and binding in all matters relating to the Promotion. If you have any complaints you can contact us using the contact details provided on the Via Platform.
19. We reserve the right, in exceptional circumstances, to vary, amend or withdraw the Promotion on reasonable notice.
20. Nothing in these terms shall limit or exclude our liability to you for death or personal injury caused by our negligence, for fraudulent misrepresentation, or for any other liability that, by law, may not be limited or excluded. Subject to this, in no event shall we be liable to you for any loss, damage or disappointment suffered as a result of your entering (or inability to enter) the Promotion or your acceptance or non-acceptance of the Prize if you win.
21. These terms and the Promotion shall be governed by the laws of the Netherlands. Any disputes arising out of or in connection to these terms or the Promotion shall be settled by the competent courts in Amsterdam, the Netherlands.
